Terms of use

These Terms of Use govern access to the Seminar Engine website and application operated by Boydston Marketing. By accessing or using Seminar Engine, you agree to these terms. A separate written service agreement may include additional terms and controls if it conflicts with these terms.
1. Website and service use
Seminar Engine provides seminar marketing, registration, communications, check-in, advertising integration, attribution, and reporting tools. You may use the website and service only for lawful business purposes and in accordance with these terms, our Privacy Policy, applicable platform policies, and any written service agreement.
2. No service agreement from website activity
Website content, public pricing, an audit request, or a sales conversation does not itself create a client relationship. Managed services begin only under a separate written agreement defining scope, timing, responsibilities, pricing, and applicable terms.
3. Accounts, eligibility, and authority
You must be at least 18 years old and authorized to act for the organization associated with your account. You are responsible for accurate account information, safeguarding credentials, controlling authorized users, and promptly notifying us of suspected unauthorized access.
You may connect only advertising accounts, businesses, pixels, conversion actions, domains, and other assets that you own or are expressly authorized to manage. You represent that you have authority to grant Seminar Engine the permissions selected during authorization and to instruct us to process the related data.
4. Google and Meta connections
Google and Meta connections are optional. When you initiate a connection, the provider displays the permissions requested and you choose whether to grant them. Seminar Engine uses those permissions to discover the advertising assets available to you, save the assets you select, import campaign reporting and spend, and send configured measurement events. Features remain subject to the settings and capability switches available in Seminar Engine.
Use of Google services is also governed by the applicableGoogle API terms and policies. Use of Meta services is also governed by the applicableMeta Platform Termsand related product policies. Google and Meta control their platforms, permissions, review processes, APIs, and availability. We do not guarantee that either provider will approve, maintain, or continue any integration.
You may disconnect a provider in Seminar Engine at any time. Disconnecting removes the saved credential and stops future activity for that client connection, but it may not revoke an authorization used by another client connection. You may separately revoke Seminar Engine through the provider’s account settings. See our data deletion instructions.
5. Customer responsibilities
You are responsible for:
- The legality, accuracy, and permissions for data, content, audiences, advertising assets, and instructions you provide.
- Providing required notices and obtaining valid consent for communications, cookies, pixels, conversion measurement, and advertising.
- Configuring provider settings and Seminar Engine capability switches consistent with applicable law, industry rules, and provider policies.
- Reviewing campaign content, targeting, budgets, registrations, and reported outcomes for accuracy and appropriateness.
- Responding to data-subject and consumer requests when your organization determines the purpose of processing.
6. Healthcare and sensitive information
You must not instruct Seminar Engine to send medical records, protected health information, or other sensitive information to Google, Meta, or another advertising platform in violation of law, contract, or platform policy. Seminar Engine’s restricted-data and consent controls are safeguards, not a substitute for your legal and compliance review. The service does not by itself make a seminar, campaign, or practice compliant with HIPAA, state privacy law, advertising rules, or provider requirements.
7. Acceptable use
You may not:
- Use the service unlawfully, deceptively, or to violate another person’s rights.
- Access data, accounts, tenants, or provider assets without authorization.
- Attempt to bypass security, permissions, rate limits, or technical restrictions.
- Upload malicious code or interfere with the operation or security of the service.
- Use connected-provider data for surveillance, discrimination, eligibility decisions, data brokerage, or unrelated profiling.
- Resell, sublicense, copy, or reverse engineer the service except where law prohibits this restriction.
8. Data and privacy
Our Privacy Policy explains how we collect, use, protect, retain, share, and delete information, including Google user data and Meta Platform Data. You retain your rights in content and data you provide. You grant us the limited rights necessary to host, process, transmit, and display that information to provide, secure, support, and improve the user-facing service.
9. Pricing, ad spend, and availability
Published service pricing may change prospectively. Unless a written agreement says otherwise, media spend and third-party charges are paid directly by the client and are not included in Seminar Engine pricing. Market fit, event feasibility, timing, account access, provider approval, and final scope are qualified before an engagement is accepted.
10. Results
Marketing performance varies by offer, audience, location, budget, competition, account history, platform behavior, operational follow-through, and other factors. No website or service statement guarantees registrations, attendance, patients, revenue, advertising approval, or return on ad spend.
11. Intellectual property
Seminar Engine, its logo, software, site design, copy, documentation, and original materials are owned by or licensed to Boydston Marketing. Except for rights expressly granted in a written agreement, you may not reproduce, distribute, modify, or commercially exploit them without written permission.
12. Third-party services
The service may depend on or link to third-party platforms. Their content, data practices, terms, performance, and availability are controlled by those third parties. We are not responsible for changes, suspensions, errors, or losses caused by a third-party service beyond our reasonable control.
13. Suspension, termination, and disconnection
We may limit or suspend access when reasonably necessary to address a security risk, unlawful activity, nonpayment, platform-policy concern, material breach, or threat to the service or others. You may stop using the service or disconnect a provider at any time, subject to your written service agreement. Sections that by their nature should survive will survive termination, including ownership, payment obligations, disclaimers, limitations, and dispute terms.
14. Disclaimers
To the fullest extent permitted by law, the website and service are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.
15. Limitation of liability
To the fullest extent permitted by law, Boydston Marketing and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or advertising opportunity, arising from the website, service, or a third-party platform. Any liability that cannot be excluded will be limited as provided in the applicable written service agreement or, if none applies, to the amount paid for the affected service during the three months before the event giving rise to the claim.
16. Governing law
These terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any dispute not governed by a separate written agreement will be brought in the state or federal courts located in Utah County, Utah, and the parties consent to their jurisdiction.
17. Changes
We may update these terms as the service or legal requirements change. We will post the revised terms and update the date above. Material changes will apply prospectively and receive additional notice when required.
